SUBMITTING A REPORT AND PROTECTION OF WHISTLEBLOWERS – INFORMATION TO BE PUBLISHED IN A MANNER ALLOWING REMOTE ACCESS

B 27253 (hereinafter referred to as ‘OTK’),  in accordance with Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons reporting breaches of Union law (hereinafter referred to as the “Directive”) and the Act No. 171/2023 Coll., on the protection of whistleblowers (hereinafter referred to as the “Act”), hereby informs whistleblowers whose rights are protected, in accordance with the provisions of Section 9(2)(b) of the Act, of the following facts:

Reports can be submitted via OTK’s internal reporting system:

  • in writing to the email address whistleblowing@spgroup.cz,
  • by telephone during opening hours, 8.00 am – 2.00 pm, on +420 221 907 217,
  • in writing via the JOBka app,
  • in writing, into the physical suggestion box located by the OTK canteen,
  • by telephone during opening hours, 8.00 – 14.00 on every working day,
  • at the request of the notifier, in person, by arrangement with the relevant person.

If the complainant requests to submit the complaint in person, the relevant person is obliged to accept the complaint in person within a reasonable period of time, and no later than 14 days from the date on which the complainant made the request.

The above-mentioned channels are managed by the relevant persons in accordance with the provisions of Section 10 of the Act, who are currently:

The obliged entity shall exclude the acceptance of reports from any person who does not carry out work or any other similar activity for the obliged entity in accordance with Section 2(3)(a), (b), (h) or (i) of the Whistleblower Protection Act, i.e. from persons who do not carry out dependent work for the obliged entity within the framework of a basic employment relationship, nor do they perform military service, voluntary work, professional placements or work experience placements.

Anonymous reports will not be accepted or dealt with by the relevant body. Anonymous whistleblowers are not entitled to protection under the Whistleblower Protection Act. 

Reports can also be submitted via the external reporting system of the Ministry of Justice of the Czech Republic. Further information for whistleblowers is available on the website oznamovatel.jus ce.cz, where reports can also be submitted.
